ANNOUNCEMENT ABOUT THOSE WHO MAKE TRANSACTIONS ON THEIR BEHALF, ON SOMEONE ELSE'S ACCOUNT

The Regulation on Measures to Prevent the Laundering of Proceeds of Crime and the Financing of Terrorism, prepared on the basis of Article 27 of the Law No. 5549 on the Prevention of Laundering Proceeds of Crime (the Law) (the “Regulation”), was published in the Official Gazette dated 09.01.2008 and entered into force on 01.04.2008. According to the regulation, it is mandatory to obtain customer identity information regardless of the amount in continuous business relationships that have an element of continuity by nature, such as VISIONPAY's electronic wallet account opening service, and to take the necessary measures to identify customers and those acting on behalf of the customer by confirming the accuracy of this information, and to reveal the true beneficiary of the transaction. Apart from this, although it does not constitute a permanent business relationship; ​ 

  • When the transaction amount or the total amount of more than one related transaction is 185 thousand TL or more,

  • In electronic transfers, when the transaction amount or the total amount of more than one related transaction is 15 thousand TL or more,

  • In cases requiring notification of suspicious transactions, regardless of the amount, 

  • When there is doubt about the adequacy and accuracy of previously obtained customer identification information, regardless of the amount it is mandatory to obtain information about the identity and to determine the identity of the customers and those acting on behalf of the customers or on their account by confirming the accuracy of this information.

 In the identification of real persons; the name, surname, place and date of birth, nationality, type and number of the identity document, address and signature sample, information about the job and profession of the person concerned, phone number, fax number, e-mail address, if any, and mother, father's name and  in addition to this information for Turkish citizens. The TC identification number is taken.

 In accordance with Article 6 / A of the Regulation, remote identification methods can be used to verify the customer's identity.

 

In the identification of legal entities registered in the trade registry; the legal entity's title, trade registry number, tax identification number, subject of activity, open address, telephone number, fax number and electronic mail address, if any, as well as information about the name, surname, place and date of birth, nationality, type and number of the identity document of the person authorized to represent the legal entity, and a sample signature, as well as the mother, father's name and , in addition to these information for Turkish citizens TC the identification number is taken. ​ 

The accuracy of the identity information of the persons authorized to represent the legal entity is confirmed by the identity documents specified in Article 6, and the powers of representation are confirmed by the documents related to registration. The identity of the real and legal person partners with shares exceeding twenty-five percent of the legal entity shall be determined in accordance with Articles 6 and 7 of the Regulation. ​

 

Customers who open an electronic wallet account or make transactions on VISIONPAY, if they are making transactions or transactions to be made from this account to someone else's account, they must declare this before making the transaction or transactions. Upon this declaration, the identity and authorization status of the person requesting the transaction and the identity of the person whose account was acted on shall be determined in accordance with the provisions between Articles 6 and 14 of the Dec. According to Article 15 of the Law, in transactions where identification is required, a person acting on his own behalf but on someone else's account is punished with a prison sentence of six months to one year or a judicial fine of up to five thousand days if he does not inform in writing whose account he is acting on before making these transactions. This announcement is made in accordance with Article 17 of the Regulation.
